Kwiki Terms and Conditions Policy

I. Acceptance of Terms

By accessing and using the Kwiki digital services network, which includes a mobile app and a website (hereinafter referred to as the "Service Network"), from within the United Mexican States, you agree to be bound by this Terms and Conditions Policy (hereinafter the "Policy"). If you disagree with any part of the Policy, you are prohibited from accessing the service. Kwiki reserves the right to terminate these Terms and Conditions, any aspect of the Services linked to you, or suspend or restrict access to the Services or parts thereof, at any time and for any reason, unilaterally.


II. Changes to the Terms

Kwiki reserves the right to modify the Policy related to the Services provided in any way and at any time deemed appropriate. Changes will take effect upon the announcement of the revised versions of the Policy in this location or additional conditions related to the corresponding Service. Continued or repeated use of the Services by the User after such announcement constitutes your express acceptance and agreement to the Policy and its modifications.

 

III. Definitions

a) Content: Text, graphics, images, music, software, audio, video, information, or other materials.

b) Framing: Methods used to display content from one web page within another using frames or iframes to integrate third-party content into a site, create fixed navigation panels, or develop complex web applications that load dynamic content.

c) Push Notifications: Messages sent directly to a user’s mobile device or browser from a server to inform Users about news, app updates, personal messages, promotions, event reminders, and more.

d) Product: Any goods offered for commercial purposes on the Kwiki Service Network.

e) Delivery Person: An individual responsible for collecting the User’s order from its starting point, transporting it entirely to its destination, and delivering it to the User. The delivery person acknowledges that their services are provided voluntarily and independently to Kwiki.

f) Service: The functionality provided by Kwiki through its service network to facilitate access to and/or delivery of products and services.

g) Business Partner: A person or entity offering products and services through the service network for commercial purposes.

h) User: Any individual who accesses, browses, uses, or contributes to the content of the service network to acquire products and services offered by Business Partners.

 

IV. Provision of Services

a. Kwiki reserves the right to suspend, cancel, or discontinue any or all of the Services it provides at any time without prior notice. It may also modify any or all Content, Products, and Services without prior notification.

b. You acknowledge that if Kwiki limits or deactivates access to your account, this may result in an inability to access the Services, account details, or any content or files therein, affecting configurations or transactions on the Kwiki Service Network for the duration deemed appropriate by Kwiki.

c. You accept that Kwiki may conduct research and experimentation with components of its Service Network, leading to different experiences for certain Users compared to others at any given time.

d. Disclaimers:

  • Kwiki disclaims any responsibility for outdated information since the last Policy update. It does not guarantee the quality, availability, or prices listed in Business Partner menus.
  • Certifications, licenses, or permits displayed in Business Partner profiles are for informational purposes and not guaranteed for accuracy or validity.

e. Kwiki reserves the right to charge subscriptions, membership fees, or any other charges at its discretion, notifying Users at least 24 hours in advance via email or Push Notifications.

f. Kwiki may offer referral or incentive programs subject to their specific Terms and Conditions. Kwiki reserves the right to modify or discontinue such programs without prior notice.

g. Kwiki may provide credits, promo codes, or vouchers to Users, subject to change or discontinuation at Kwiki’s discretion.

 

V. User Responsibilities

a. Users are responsible for all activities under their accounts and must immediately report unauthorized access to Kwiki.

b. By creating an account, Users agree to receive platform-related communications.

c. Users guarantee the accuracy and validity of provided information and commit to updating it as needed.

 

VI. Intellectual Property

  1. Ownership: All content on the Kwiki Service Network is owned by Kwiki or used under license. Reproduction, distribution, or modification without written consent is prohibited.
  2. User Rights: Users are granted a limited, personal, non-transferable, and non-exclusive license to access Services in compliance with this Policy.
  3. Permissions Granted to Kwiki: By uploading content, Users grant Kwiki a global, perpetual, royalty-free license to use, modify, and distribute the content.

 

VII. Service Fees

Kwiki charges variable fees to Users and Business Partners for services provided. Fee details are displayed during checkout.

 

VIII. Restricted Items

  1. Tobacco and Alcohol: Deliveries require age verification.
  2. Prescription Medications: Controlled substances require valid prescriptions.

 

IX. Order Cancellations and Refunds

Users can cancel orders before preparation without penalty. Refunds are processed as platform credits or to payment cards, subject to bank processing times.

 

X. Confidentiality

Kwiki protects user information in accordance with applicable laws and its Privacy Policy.

 

XI. Insurance

Kwiki maintains adequate insurance for its operations, but service providers are responsible for their own coverage.

 

XII. Anti-Corruption

Users and service providers agree to comply with anti-corruption laws.

 

XIII. Acceptance of Policy

Users affirm they have the legal capacity to accept this Policy and agree to comply with its terms.

 

XIV. General Provisions

This Policy is governed by the laws of the United Mexican States, and disputes are subject to local courts.
